Mississippi Joins $400 Million Settlement Over Price-Fixing Claims
Attorney General Lynn Fitch has joined a coalition of 43 states and territories announcing a $400 million settlement in principle with Sandoz Inc., resolving allegations that the generic drug manufacturer engaged in widespread, long-running conspiracies to artificially inflate and manipulate prices, reduce competition and unreasonably restrain trade on numerous generic prescription drugs, her office announced August 5.
“Generic drugs are supposed to be a more affordable alternative, and through this litigation and settlement, we are holding the companies that have kept prices artificially high accountable for taking advantage of families,” Fitch said. “We are committed to taking action to lower your drug costs and we will continue to pursue transparency, accountability, and affordability for Mississippi consumers.”
According to the announcement, the states have also secured settlements in the same litigation with Glenmark, Lannett, Bausch, Apotex and Heritage totaling approximately $96.5 million. If approved, Sandoz will pay a total of approximately $469 million to settle the states’ claims, including amounts paid under previous settlements with other states. The settlement is contingent on obtaining signatures from all necessary states and territories, and comes as the states prepare for an anticipated trial in 2027.
National reporting on the agreement, including by STAT News, indicates the $400 million would be paid over seven years beginning in 2027 and that Sandoz did not admit wrongdoing. The announcement did not specify Mississippi’s individual share of the settlement.
